A. About this Privacy Statement

1. The purpose of this Privacy Statement is to inform you of how Times Publishing Limited and its subsidiaries including Pansing Distribution Pte Ltd (collectively referred to as the "TPL Group", "we", "us" or "our"), manage Personal Data.

2. This Privacy Statement applies to all TPL Group websites ("Group Websites”), and describes how we collect, use, disclose and process your Personal Data including Personal Data we have collected about you and Personal Data that you have provided to us through the Group Websites or otherwise.

3. Although this Privacy Statement is in common use by TPL Group, except where applicable laws provide otherwise, each entity within TPL Group is only responsible to you in relation to its own collection and use of your Personal Data and its own actions.

4. We are committed to safeguarding your Personal Data. This Privacy Statement supplements but does not supersede or replace any other consents you may have provided to us, or any other agreements or arrangement that you may have with us, in respect of your Personal Data. Your consents herein are additional to any rights which the TPL Group may have to collect, use and disclose your Personal Data.

5. By providing us with your Personal Data, whether through the Group Websites or otherwise, you consent, agree and accept that we, as well as our respective representatives and/or agents may collect, use, disclose and share among ourselves your Personal Data as described in this Privacy Statement.

B. Amendments to this Privacy Statement

6. We review and may amend this Privacy Statement from time to time to reflect changes in applicable laws or the way we handle Personal Data. The updated Privacy Statement will supersede earlier versions and will apply to Personal Data provided to us previously. You are encouraged to re-visit our Privacy Statement from time to time to keep yourself updated on these changes.

C. What Personal Data We Collect

7. What is Personal Data. In this Privacy Statement, “Personal Data” refers to data that can be used to identify a natural person. Examples of Personal Data include name, address, contact details, identification numbers, IP address, transactional information based on your activities on our website and applications, telephone numbers, email address, images and any other information of a personal nature.

8. Voluntary provision of Personal Data. We collect Personal Data that you voluntarily provide to us. What Personal Data we collect depends on the purposes for which the Personal Data is collected and what you have chosen to provide.

You can choose not to provide us with Personal Data. If you have provided consent, you also have the right to withdraw your consent by contacting us in accordance with Paragraph 26. However, if you do so, it may not be possible for us to fulfil the purposes for which we require the Personal Data, including processing your transactions or providing you with the products and services that you require.

9. Providing Personal Data belonging to others. If you provide the Personal Data of anyone other than yourself (e.g. your family members), you are responsible for informing him/her of the specific purposes for which we are collecting his/her Personal Data and to ensure that he/she has provided valid consent for your provision of his/her Personal Data to us.

10. Accuracy and Completeness of Personal Data. It is important that the Personal Data we hold about you is accurate and up to date. It is your responsibility to ensure that all Personal Data that you provide is accurate and complete and to inform us of relevant changes to your Personal Data.

11. Minors. If you are a minor under 16 years of age, please obtain consent from your parent or guardian before you submit any Personal Data to us. If you are a parent or guardian of a minor and you have reason to believe your child or ward has provided us with their Personal Data without your prior consent, please contact us to request for erasure of their Personal Data or for the minor to be unsubscribed from our mailing lists.

  • when we seek information about you and receive your Personal Data in connection with your relationship with us. For example, if you are an investor or shareholder of organisations within TPL Group;
  • when you submit an employment, internship or secondment application to us or when you provide documents or information including your resume/CVs in connection with such applications; and/or

13. Personal Data Provided by others. Depending on your relationship with us, we may also collect your Personal Data from third party sources, for example:

  • from our business partners such as third parties providing advertising, marketing and promotional services to us;
  • from your referees, educational institutions or previous employers (if you have applied to us for a job);
  • from your family members or friends who provide your Personal Data to us on your behalf; and/or
  • from public agencies or other public sources.

E. Purposes for Collection, Use or Disclosure of Your Personal Data

14. General Purposes. Generally, we collect, use, disclose and process your Personal Data for purposes connected or relevant to our business or to manage your relationship with us. Depending on the jurisdiction you are in and where the relevant TPL Group entity operates, the TPL Group and our third party service providers as the case may be, may use your Personal Data:

  • to facilitate and process your transactions with us, or to provide products and services to you;
  • for administrative purposes, including to facilitate your participation in our promotions, sales initiatives or contests, to evaluate your preferences, to facilitate your access to Group Websites and for the maintenance of the Group Websites and other quality assurance purposes;
  • to register you as a member of any of our programmes (including loyalty programmes) and to provide you the benefits of such membership;
  • to send you promotional and marketing material via email, post or telephone where appropriate;
  • to carry out research and statistical analysis including development of new products and services or evaluation and improvement of our existing products and services;
  • to answer your queries or provide you with assistance in any other way including resolving complaints and assisting you with your requests enquiries and feedback;
  • to comply with any applicable rules, laws, regulations, codes of practice or guidelines issued by any legal or regulatory body which are binding on us;
  • enforcing legal obligations owed to us or responding to complaints, litigation or investigations concerning us;

If you have given your consent, we may use your Personal Data for the purposes of marketing our products and services and those of our strategic partners and business associates for marketing and communication purposes e.g. informing you of our latest activities, special offers and promotions. In order for us to market products and services which are of special interest and relevant to you, we may analyse and rely on your overall interaction with us (such as but not limited to your participation in promotions or events and your interactions with us).

16. How We Share Your Personal Data. Depending on the jurisdiction you are in or where the relevant TPL Group entity operates, in order to fulfil the above purposes, we may share your Personal Data with the following entities:

  • Other entities of the TPL Group;
  • The holding company of Times Publishing Limited, Fraser and Neave, Limited and its subsidiaries;
  • Third-party vendors and service providers (such as subcontractors, agents or network operators) who are employed to perform business, support, operational and/or administrative functions such as marketing, payment, fulfillment and delivery of orders;
  • Third parties with whom we conduct joint marketing and/or cross-promotions, including providing rewards or benefits; and
  • Our professional advisers such as auditors and lawyers.

Some of the above entities may be located outside of the country/region where your data was first collected by the relevant TPL GROUP Entity. Where this is the case, your Personal Data may be transferred overseas from time to time. Such transfers will be carried out in accordance with relevant data protection laws.

Third parties are subject to confidentiality obligations and may only use your Personal Data to perform the necessary functions and not for other purposes.

17. Use of Cookies. A cookie is a small piece of information that is placed on your Internet browsing software (the “browser”) by a website that you visit. It helps the website to remember information about your visit to make your next visit easier and the site more useful to you.

We may use cookies on Group Websites for the following purposes:

  • To enable certain features and functions on Group Websites (e.g. remembering your user-ID, browsing and other product and/or service preferences);
  • To identify the causes of problems arising at web servers and to resolve these problems or improve efficiency of Group Websites;
  • To improve the contents of Group Websites and emails from us;
  • To customize the contents of Group Websites and emails from us to suit your individual interests or preferences;

By clicking on or activating such links and leaving Group Websites, we can no longer exercise control over any data or information which you give to any other entity after leaving Group Websites. Any access to such other sites or pages is therefore entirely at your own risk. We are not responsible for the Personal Data policies (including Personal Data protection and cookies), content or security of any third party websites linked to or from Group Websites.

19. Legitimate Interests and other legal basis for processing. In addition to collecting, using, disclosing and processing your Personal Data with your consent or for performance of a contract entered with you, we may also use and process your Personal Data to support our legitimate business interests in accordance with applicable data protection laws.

20. Use permitted under applicable laws. We may also collect, use, disclose and process your Personal Data without your knowledge or consent where this is required or permitted under law.

22. Unauthorised Access. While precautions will be taken to ensure that the Personal Data you provide is protected again unauthorized or unintended access, we cannot be held responsible for unauthorized or unintended access that is beyond our control.

23. Vulnerabilities. We do not guarantee that our systems or applications are invulnerable to security breaches nor do we make any warranty, guarantee or representation that your use of our systems or applications is safe and protected from viruses, worms, Trojan horses and other vulnerabilities. We also do not guarantee the security of data that you choose to send us electronically. Sending such data is entirely at your own risk.

24. Period of Retention. Your Personal Data will be retained for as long as it is necessary to fulfill the purpose for which it is collected or for business or legal purposes, or in accordance with applicable laws. Should you choose to unsubscribe from our mailing list or if your membership expires, please note that your Personal Data may still be retained on our database to the extent permitted by law.

25. Anonymised Data. In some circumstances we may anonymise your Personal Data so that it can no longer be associated with you, in which case we are entitled to retain and use such data without restriction.

  • Withdrawing Consent:
    If you withdraw your consent to any or all use of your Personal Data, depending on the nature of your request, we may not be able to provide or continue providing our products and services to you, or administer any contractual relationship already in place. You understand and agree that in such instances where we require your Personal Data to fulfil a contractual obligation to you and you withdraw your consent to collect, use or disclose the relevant Personal Data for those purposes, we cannot be held liable for breach of that agreement. Our legal rights and remedies in such event are expressly reserved.

27. If you wish to exercise your rights, you may contact us in accordance with Paragraph 26. We may require that you submit certain forms or provide certain information to process your request. Where permitted by law we may also charge you a fee to process your request.

28. Limitations: We may be permitted under applicable laws to refuse a request, for example, we may refuse an access request in respect of (a) opinion data or (b) Personal Data which is subject to legal privilege.

PENYATAAN PRIVASI

A.    Mengenai Penyataan Privasi ini

1.    Tujuan Penyataan Privasi ini adalah untuk memberitahu anda bagaimana Times Publishung Limited dan anak syarikatnya (secara kolektif disebut sebagai "TPL Group", "we", " us" atau "our"), menguruskan Data Peribadi anda.

2.    Penyataan Privasi ini terpakai kepada semua laman web KUMPULAN TPL ("Laman Web Kumpulan"), dan menerangkan bagaimana kami mengumpulkan, menggunakan, menzahirkan dan memproses Data Peribadi anda termasuk Data Peribadi yang kami telah kumpulkan mengenai anda dan Data Peribadi yang telah diberikan oleh anda kepada kami melalui Kumpulan Laman web atau sebaliknya.

3.    Walaupun Penyataan Privasi ini digunakan secara am oleh Kumpulan TPL, kecuali jika undang-undang yang berkaitan menetapkan sebaliknya, setiap entiti dalam Kumpulan TPL hanya bertanggungjawab kepada anda berhubung dengan pengumpulan dan penggunaan Data Peribadi anda oleh entiti tersebut dan tindakannya sendiri.  

4.    Kami komited untuk melindungi Data Peribadi anda. Penyataan Privasi ini melengkapkan tetapi tidak menggantikan persetujuan lain yang mungkin anda telah berikan kepada kami, atau perjanjian atau pengaturan lain yang mungkin anda miliki bersama kami, berkenaan dengan Data Peribadi anda. Persetujuan anda di sini adalah tambahan kepada sebarang hak yang mana Kumpulan TPL mungkin mengumpul, mengguna dan menzahirkan Data Peribadi anda.

5.    Dengan memberikan Data Peribadi anda kepada kami, sama ada melalui Laman Web Kumpulan atau sebaliknya, anda membenarkan, bersetuju dan menerima bahawa kami, serta wakil dan/atau ejen kami masing-masing boleh mengumpulkan, menggunakan, menzahirkan dan berkongsi di antara kami Data Peribadi anda seperti yang dijelaskan dalam Penyataan Privasi ini.

B.    Pindaan pada Penyataan Privasi ini

6.    Kami mengkaji dan boleh meminda Penyataan Privasi ini dari semasa ke semasa untuk mencerminkan perubahan dalam undang-undang yang berkaitan atau cara kami menguruskan Data Peribadi. Penyataan Privasi yang dikemas kini akan menggantikan versi sebelumnya dan akan terpakai kepada Data Peribadi yang diberikan kepada kami sebelumnya. Anda digalakkan untuk mengunjungi semula Penyataan Privasi kami dari semasa ke semasa untuk memastikan anda maklum terhadap perubahan ini.

C.    Apa Data Peribadi yang Kami Kumpulkan

7.    Apa itu Data Peribadi. Dalam Penyataan Privasi ini, "Data Peribadi" merujuk kepada data yang boleh digunakan untuk mengenal pasti orang biasa. Contoh Data Peribadi termasuk nama, alamat, maklumat hubungan, nombor pengenalan, alamat IP, maklumat transaksi berdasarkan aktiviti anda di laman web dan aplikasi kami, nombor telefon, alamat e-mel, gambar dan maklumat lain yang bersifat peribadi.

8.    Penyediaan Data Peribadi secara sukarela. Kami mengumpulkan Data Peribadi yang anda berikan secara sukarela kepada kami. Data Peribadi yang kami kumpulkan bergantung pada tujuan Data Peribadi dikumpulkan dan apa yang telah anda pilih untuk memberikan.

Anda boleh memilih untuk tidak memberikan Data Peribadi kepada kami. Sekiranya anda telah memberikan persetujuan, anda juga berhak untuk menarik balik persetujuan anda dengan menghubungi kami sesuai dengan Perenggan 26. Namun, jika anda melakukannya, kami mungkin tidak boleh memenuhi tujuan yang mana kami perlukan Data Peribadi tersebut, termasuk memproses transaksi anda atau memberi anda produk dan perkhidmatan yang anda perlukan.

9.    Menyediakan Data Peribadi milik orang lain. Sekiranya anda memberikan Data Peribadi orang lain selain diri anda (contohnya ahli keluarga anda), anda bertanggungjawab untuk memaklumkan kepada mereka tentang tujuan khusus kami mengumpulkan Data Peribadi mereka dan memastikan bahawa mereka telah memberikan persetujuan yang sah untuk pemberian Data Peribadi mereka kepada kami.

10.    Ketepatan dan Kelengkapan Data Peribadi. Ia penting bahawa Data Peribadi yang kami simpan mengenai anda adalah tepat dan terkini. Tanggungjawab anda adalah untuk memastikan bahawa semua Data Peribadi yang anda berikan adalah tepat dan lengkap dan untuk memberitahu kami mengenai perubahan yang relevan terhadap Data Peribadi anda.

11.    Kanak-kanak di bawah umur. Sekiranya anda berumur di bawah 18 tahun, sila dapatkan persetujuan daripada ibu bapa atau penjaga anda sebelum anda memberikan sebarang Data Peribadi kepada kami. Sekiranya anda adalah ibu bapa atau penjaga kanak-kanak bawah umur dan anda mempunyai alasan untuk mempercayai bahawa anak atau jagaan anda telah memberikan kami Data Peribadi mereka tanpa persetujuan anda terlebih dahulu, sila hubungi kami untuk meminta penghapusan Data Peribadi mereka atau agar anak di bawah umur berhenti melanggan dari senarai mel kami.

D.    Bagaimana Kami Mengumpulkan Data Peribadi

12.    Data Peribadi yang anda berikan. Kami mengumpulkan Data Peribadi yang berkaitan dengan hubungan kami dengan anda. Data Peribadi anda mungkin dikumpulkan oleh kami, secara langsung atau tidak langsung, contohnya: 

  • semasa anda melawati Laman Web Kumpulan dengan penyemak imbas yang menggunakan kuki atau mendaftarkan akaun pengguna dengan Laman Web Kumpulan atau menggunakan beberapa perkhidmatan laman web dan aplikasi mudah alih kami termasuk membuka akaun atas talian dengan kami; 
  • semasa anda melaksanakan sebarang transaksi atas talian (seperti membeli-belah atas talian atau membuat pembelian atau tempahan atas talian) di Laman Web Kumpulan atau melalui penyedia perkhidmatan pihak ketiga kami, atau penyedia perkhidmatan lain yang mungkin kami gunakan dari semasa ke semasa;
  • semasa anda memuat turun atau menggunakan mana-mana aplikasi mudah alih kami (aplikasi); 
  • apabila anda memohon menjadi ahli untuk salah satu daripada program kami termasuk program kesetiaan; 
  • semasa anda memasuki atau membalas atau mengambil bahagian dalam promosi, inisiatif, pertandingan, permainan atau peraduan kami; 
  • semasa anda menghadiri acara atau majlis penjualan dan pemasaran kami;
  • semasa gambar anda dirakam melalui gambar atau video anda yang diambil semasa anda mengambil bahagian dalam acara yang dianjurkan oleh kami;
  • apabila anda melanggan senarai mel kami untuk langganan e-mel, promosi pos atau telefon atau bentuk pemasaran lain (seperti melalui panggilan telefon, pesanan melalui SMS/MMS dan WhatsApp);
  • semasa anda berkomunikasi atau berinteraksi dengan kami melalui telefon, e-mel melalui laman web kami atau melalui saluran komunikasi lain, seperti platform media sosial atau pertemuan bersemuka;
  • semasa kami mencari maklumat mengenai anda dan menerima Data Peribadi anda sehubungan dengan hubungan anda dengan kami. Sebagai contoh, jika anda adalah pelabur atau pemegang saham organisasi dalam Kumpulan TPL;
  • semasa anda mengemukakan permohonan pekerjaan, latihan industri atau penempatan kepada kami atau semasa anda memberikan dokumen atau maklumat termasuk resume/CV anda yang berkaitan dengan permohonan tersebut; dan/atau 
  • semasa anda memberikan Data Peribadi anda kepada kami untuk alasan lain.

13.    Data Peribadi Disediakan oleh orang lain. Bergantung pada hubungan anda dengan kami, kami juga dapat mengumpulkan Data Peribadi anda daripada sumber pihak ketiga, contohnya:

  • daripada rakan niaga kami seperti pihak ketiga yang menyediakan perkhidmatan pengiklanan, pemasaran dan promosi kepada kami;
  • daripada rujukan anda, institusi pendidikan atau majikan terdahulu (jika anda telah memohon pekerjaan kepada kami);
  • daripada ahli keluarga atau rakan anda yang memberikan Data Peribadi anda kepada kami bagi pihak anda; dan / atau
  • daripada agensi awam atau sumber awam lain .

E.    Tujuan Pengumpulan, Penggunaan atau Penzahiran Data Peribadi Anda

14.     Tujuan Am. Secara amnya, kami mengumpulkan, menggunakan, menzahirkan dan memproses Data Peribadi anda untuk tujuan yang berkaitan atau bersesuaian dengan perniagaan kami atau untuk menguruskan hubungan anda dengan kami. Bergantung pada bidang kuasa di mana anda berada dan di mana entiti Kumpulan TPL yang berkaitan beroperasi, KUMPULAN TPL dan penyedia perkhidmatan pihak ketiga kami mengikut mana-mana, mungkin menggunakan Data Peribadi anda: 

  • untuk memudahkan dan memproses transaksi anda dengan kami, atau untuk menyediakan produk dan perkhidmatan kepada anda;
  • untuk tujuan pentadbiran, termasuk untuk memudahkan penyertaan anda dalam promosi, inisiatif penjualan atau peraduan kami, untuk menilai pilihan anda, untuk memudahkan akses anda ke Laman Web Kumpulan dan untuk penyelenggaraan Laman Web Kumpulan dan tujuan jaminan kualiti yang lain;
  • untuk mendaftarkan anda sebagai ahli mana-mana program kami (termasuk program kesetiaan) dan memberi anda faedah keahlian tersebut;
  • untuk menghantar bahan promosi dan pemasaran kepada anda melalui e-mel, pos atau telefon di mana sesuai;
  • untuk menjalankan penyelidikan dan analisis statistik termasuk pengembangan produk dan perkhidmatan baru atau penilaian dan peningkatan produk dan perkhidmatan sedia ada;
  • untuk menjawab pertanyaan anda atau memberi anda bantuan dengan cara lain termasuk menyelesaikan aduan dan membantu anda dengan pertanyaan dan maklum balas permintaan anda;
  • untuk mematuhi segala peraturan berkaitan, undang-undang, peraturan, kod amalan atau panduan yang dikeluarkan oleh badan perundangan atau peraturan yang mengikat kami; 
  • menguatkuasakan kewajiban undang-undang yang terhutang kepada kami atau menjawab aduan, proses pengadilan atau penyiasatan melibatkan kami;
  • tujuan-tujuan lain yang mungkin dimaklumkan kepada anda semasa Data Peribadi anda dikumpulkan; dan/atau 
  • apa-apa tujuan munasabah lain yang berkaitan dengan yang dinyatakan di atas.

15.    Tujuan Pemasaran. Sekiranya anda telah memberikan persetujuan anda, kami mungkin menggunakan Data Peribadi anda untuk tujuan memasarkan produk dan perkhidmatan kami dan rakan kongsi strategik dan rakan perniagaan kami untuk tujuan pemasaran dan komunikasi, contohnya memberitahu anda mengenai aktiviti terkini, tawaran istimewa dan promosi kami. Agar kami dapat memasarkan produk dan perkhidmatan yang menarik dan relevan dengan anda, kami mungkin menganalisis dan bergantung pada interaksi anda secara keseluruhan dengan kami (seperti tetapi tidak terhad kepada penyertaan anda dalam promosi atau acara dan interaksi anda dengan kami).

16.    Cara Kami Berkongsi Data Peribadi Anda Bergantung pada bidang kuasa tempat anda berada atau di mana entiti Kumpulan TPL yang berkenaan beroperasi, untuk memenuhi tujuan di atas, kami dapat berkongsi Data Peribadi anda dengan entiti berikut:

  • Entiti selain dari KUMPULAN TPL;
  • Penjual dan penyedia perkhidmatan pihak ketiga (seperti subkontraktor, ejen atau pengendali rangkaian) yang digunakan untuk menjalankan fungsi perniagaan, sokongan, operasi dan/atau fungsi pentadbiran seperti pemasaran, pembayaran, pemenuhan dan penyampaian pesanan; 
  • Pihak ketiga yang dengannya kami melakukan pemasaran bersama dan/atau promosi silang, termasuk memberikan ganjaran atau faedah; dan 
  • Penasihat profesional kami seperti juruaudit dan peguam.

Sebilangan entiti di atas mungkin terletak di luar negara/rantau yang menjadi tempat data anda pertama kali dikumpulkan oleh entiti Kumpulan TPL yang berkaitan. Sekiranya ini berlaku, Data Peribadi anda mungkin dipindahkan ke luar negara dari semasa ke semasa. Pemindahan tersebut akan dilakukan sesuai dengan undang-undang perlindungan data yang relevan.

Pihak ketiga adalah bertanggungjawab atas kewajipan kerahsiaan dan hanya boleh menggunakan Data Peribadi anda untuk melaksanakan fungsi yang diperlukan dan bukan untuk tujuan lain.

17.    Penggunaan “Kuki”. Kuki adalah sebilangan kecil maklumat yang diletakkan di perisian penyemak imbas Internet anda ("penyemak imbas") oleh laman web yang anda lawati. Ini membantu laman web mengingat maklumat mengenai lawatan anda untuk menjadikan lawatan anda seterusnya menjadi lebih mudah dan laman web ini lebih berguna untuk anda.

Kami mungkin menggunakan kuki di Laman Web Kumpulan untuk     tujuan berikut:

  • Untuk mengaktifkan ciri dan fungsi tertentu di Laman Web Kumpulan (contoh: mengingat ID pengguna anda, melayari dan pilihan produk dan/atau perkhidmatan lain);
  • Untuk mengenal pasti punca masalah yang timbul di pelayan web dan untuk menyelesaikan masalah ini atau meningkatkan kecekapan Laman Web Kumpulan;
  • Untuk meningkatkan kandungan Laman Web Kumpulan dan     e-mel dari kami;
  • Untuk menyesuaikan kandungan Laman Web Kumpulan dan e-mel dari kami agar sesuai dengan minat atau pilihan individu anda;
  • Untuk memanfaatkan sejarah penyemakan imbas anda di Laman Web Kumpulan dan hasil soal selidik untuk penelitian pasar atau pemasaran, termasuk mengirimkan iklan melalui Laman Web Kumpulan kepada Anda; 
  • Untuk memperoleh statistik penggunaan dan lawatan Laman Web Kumpulan;
  • Untuk mentadbir perkhidmatan kepada anda; dan
  • Untuk tujuan yang berkaitan secara munasabah dengan yang disebutkan di atas.

Anda boleh menolak penggunaan kuki di Laman Web Kumpulan dengan mengkonfigurasi penyemak imbas anda untuk mematikan penggunaan kuki. Namun, ini boleh mengakibatkan hilangnya fungsi yang mungkin menyekat penggunaan Laman Web Kumpulan dan/atau melambatkan atau mempengaruhi cara pengoperasiannya. Sekiranya anda melumpuhkan penggunaan kuki, anda mungkin tidak lagi dapat menerima ciri peribadi dari Laman Web Kumpulan, yang bergantung pada penggunaan kuki.

18.    Pautan ke Laman Web Pihak Ketiga. Laman Web Kumpulan mungkin mengandungi pautan ke laman web dan microsite pihak ketiga yang lain, yang amalan privasinya mungkin berbeza dari laman web kami. Sekiranya anda memberikan Data Peribadi ke mana-mana laman web tersebut, Data Peribadi anda tidak tertakluk kepada Perlindungan Data dan Penyataan Privasi ini. 

Kami menggalakkan anda untuk mengkaji penyataan privasi mana-mana laman web yang anda lawati. Dengan mengklik atau mengaktifkan pautan tersebut dan meninggalkan Laman Web Kumpulan, kami tidak lagi dapat mengendalikan data atau maklumat yang anda berikan kepada entiti lain setelah meninggalkan Laman Web Kumpulan. Oleh itu, sebarang akses ke laman web atau halaman lain adalah atas risiko anda sendiri. Kami tidak bertanggungjawab untuk dasar Data Peribadi (termasuk perlindungan dan kuki Data Peribadi), kandungan atau keselamatan mana-mana laman web pihak ketiga yang dihubungkan ke atau dari Laman Web Kumpulan.

19.    Kepentingan yang sah dan asas undang-undang lain untuk diproses. Selain mengumpulkan, menggunakan, menzahirkan dan memproses Data Peribadi anda dengan persetujuan anda atau untuk melaksanakan kontrak yang dimeterai dengan anda, kami juga dapat menggunakan dan memproses Data Peribadi anda untuk mendukung kepentingan bisnes kami yang sah sesuai dengan undang-undang perlindungan data yang berkaitan.

20.    Penggunaan dibenarkan mengikuti undang-undang yang berkaitan. Kami juga dapat mengumpulkan, menggunakan, menzahirkan dan memproses Data Peribadi anda tanpa pengetahuan atau persetujuan anda di mana ini diperlukan atau dibenarkan berdasarkan undang-undang.

21.    Hubungi anda. Apabila kami menghubungi atau menghantar maklumat untuk tujuan yang dijelaskan dalam Bahagian E di atas, kami mungkin melakukannya melalui pos, e-mel, SMS, telefon atau cara lain yang disediakan oleh anda. Sekiranya anda tidak ingin menerima komunikasi atau maklumat dari kami, atau ingin menyekat cara kami menghubungi atau menghantar maklumat kepada anda, anda boleh menghubungi kami sesuai dengan Perenggan 26.

F.    KESELAMATAN DAN PENGEKALAN DATA PERIBADI

22.    Akses yang tidak dibenarkan. Walaupun langkah berjaga-jaga akan diambil untuk memastikan bahawa Data Peribadi yang anda berikan dilindungi daripada akses yang tidak izin atau akses yang tidak diingini, kami tidak akan bertanggungjawab untuk akses tanpa izin atau tidak diingini yang berada di luar kawalan kami.

23.    Kelemahan. Kami tidak menjamin bahawa sistem atau aplikasi kami kebal terhadap pelanggaran keselamatan dan kami juga tidak memberikan waranti, jaminan atau penyataan bahawa penggunaan sistem atau aplikasi kami adalah selamat dan dilindungi dari virus, worm, kuda Trojan dan kelemahan lain. Kami juga tidak menjamin keselamatan data yang anda pilih untuk dihantar kepada kami secara elektronik. Penghantaran data tersebut adalah sepenuhnya atas risiko anda sendiri.

24.     Tempoh Pengekalan. Data Peribadi anda akan disimpan selama diperlukan untuk memenuhi tujuan pengumpulannya atau untuk tujuan perniagaan atau perundangan, atau sesuai dengan undang-undang yang berkaitan. Sekiranya anda memilih untuk berhenti melanggan dari senarai mel kami atau jika keahlian anda tamat, harap maklum bahawa Data Peribadi anda mungkin masih disimpan di pangkalan data kami setakat yang dibenarkan oleh undang-undang.

25.    Data Tanpa Nama. Dalam beberapa keadaan, kami mungkin menganonimkan Data Peribadi anda sehingga tidak lagi dapat dikaitkan dengan anda, dalam hal ini kami berhak menyimpan dan menggunakan data tersebut tanpa batasan.

G.     Hak Anda 
MENGAKSES DAN MENGUBAH DATA PERIBADI ANDA

26.    Bergantung pada bidang kuasa di mana anda berada atau di mana entiti Kumpulan TPL yang berkaitan beroperasi, anda mungkin menikmati hak tertentu berdasarkan undang-undang yang berkaitan dengan pengumpulan, penggunaan, penzahiran dan pemprosesan Data Peribadi anda. Hak-hak tersebut termasuk:


  • Akses dan Pembetulan:
    Anda boleh menyemak dan mengubah Data Peribadi anda, atau menarik balik persetujuan anda terhadap penggunaan Data Peribadi anda pada bila-bila masa dengan melog masuk ke akaun pengguna anda (jika berkenaan) dan memilih "Kemas kini Profil" (atau yang setara) atau dengan menghubungi kami seperti berikut:

    Semasa menghubungi Pegawai Perlindungan Data untuk mendapatkan bantuan, sila nyatakan (jika berkaitan) nama, alamat, maklumat hubungan dan Nombor Pelanggan/Keahlian anda.

    Sila tunggu sepuluh (10) hari bekerja agar permintaan anda diproses.
  • Pengunduran Persetujuan:
    Sekiranya anda menarik persetujuan anda untuk penggunaan mana-mana atau semua Data Peribadi anda, bergantung pada jenis permintaan anda, kami mungkin tidak dapat menyediakan atau terus memberikan produk dan perkhidmatan kami kepada anda, atau menguruskan hubungan kontrak yang sudah ada. Anda memahami dan bersetuju bahawa sekiranya kami memerlukan Data Peribadi anda untuk memenuhi kewajipan kontrak kepada anda dan anda menarik balik kebenaran anda untuk mengumpulkan, menggunakan atau menzahirkan Data Peribadi yang relevan untuk tujuan tersebut, kami tidak akan bertanggungjawab atas pelanggaran perjanjian tersebut. Hak dan penyelesaian secara undang-undang kami dalam kejadian seperti itu terpelihara secara jelas.

27.    Sekiranya anda ingin menggunakan hak anda, anda boleh menghubungi kami sesuai dengan Perenggan 26. Kami mungkin menghendaki anda untuk menyerahkan borang tertentu atau memberikan maklumat tertentu untuk memproses permintaan anda. Sekiranya dibenarkan oleh undang-undang, kami juga boleh mengenakan bayaran untuk memproses permintaan anda.

28.    Pengehadan: Kami mungkin diizinkan berdasarkan undang-undang yang terpakai untuk menolak permintaan, contohnya, kami dapat menolak permintaan akses berkenaan dengan (a) data pendapat atau (b) Data Peribadi yang tertakluk pada hak istimewa undang-undang.
